2.  Introductory Remarkse

These Terms of Use (hereinafter: "Terms") represent a legally binding document for all users who wish to use the services of E387 d.o.o. (hereinafter: "Company"). By establishing a business relationship and using our services, you agree to accept these Terms in conjunction with our Privacy Policy.

3.  Definitions

- Company: E387 d.o.o., with registration number 65-01-0217-23, headquartered at Put Mladih Muslimana br. 2, Sarajevo, Centar, Bosnia and Herzegovina.
- E387 Services: The services offered by the Company, regulated by these Terms.
- Service User: A customer who uses the Company's services through the E387 application and platform. Each Service User has their own account to access and use E387 services.
- E387 Application: Application through which Service Users access E387 services.
- E387 Platform: The technology enabling Service Users to use E387 services efficiently.
- Intellectual Property Rights: All ownership rights over any part of the service, including but not limited to copyrights and trademarks, which remain the property of the Company. These Terms do not transfer or grant any intellectual property rights to the Service User.
- Agreement: An agreement between the Company and the Service User, concluded by accepting these Terms, with all rights and obligations arising from it.
- Fee: The amount paid by the Service User to the Company for the services provided.
- Payment Method: The method used to pay for services, such as credit or debit cards or other forms of payment supported by the Company.
- User Account: An account created by the Service User to use the Company’s services.
- Privacy Policy: The policy that outlines the principles and methods of processing the personal data of Service Users, which is an integral part of these Terms.

4.  Establishing a Business Relationship

Before using the certain services, the Service User must register through the E387 application and platform, providing accurate and up-to-date information and any required documentation. After successful registration, the Company will enable the Service User to access and use E387 services that require user registration and account creation.
By registering to use E387 services, the Service User guarantees that:

- They have fully read, understood, and accepted these Terms and the Privacy Policy, including all obligations arising from them.
- All information provided during registration is accurate and up-to-date.
- They will keep their User Account information current and correct.
- They will not allow others to use their account or access E387 services through their account.
- They will not use E387 services in an illegal, fraudulent, or unauthorized manner, nor abuse the E387 services, application, or platform.
- They will comply with all applicable laws while using E387 services.
- They are at least 18 years old.

5.  User Obligations

The Service User is obligated to use the services in full compliance with all applicable legal regulations. The Service User is solely responsible for any violations of regulations while using the E387 application and platform, including any damage caused to third parties, property, or other damages resulting from the use of E387 services.
The Service User is required to:
- Provide accurate information related to payment methods and ensure that their account information is up-to-date.
- Pay any fines incurred due to illegal use of the E387 service or platform.
- Report any technical issues or irregularities encountered while using the E387 services promptly.

6.  Accepted Payment Methods

E387 accepts the following payment methods on our website and application:
- Credit/Debit Cards: Mastercard®, Maestro®, Visa
The logos of the accepted cards will be displayed on the payment page. Users must ensure that their payment method is valid before registering for the service. The Company reserves the right to automatically charge overdue payments from the Service User's registered card.

7.  Security and Protection

Payment Security Statement
The confidentiality of your information is protected and secured by using the latest TLS encryption. Pages for online payment are secured by using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for the prevention of unauthorized access during data transfer.
This enables secure data transfer and prevents unauthorized data access during communication between the user and the Monri WebPay Payment Gateway and vice versa.
Monri WebPay Payment Gateway and financial institutions exchange data using a virtual private network (VPN), which is protected from unauthorized access. Monri Payments is PCI DSS Level 1 certified, ensuring the highest standards of payment security.
E387 does not store credit card numbers, and these are not accessible to unauthorized personnel.

8.  Privacy Statement

E387 is committed to protecting the personal data of our customers. We collect only the essential information necessary to fulfill our obligations, and we regularly inform our customers about how their information is used. Customers are given the choice of whether or not to provide their information for marketing campaigns.
All user information is strictly protected and is accessible only to employees who need this information to complete the job. 
All our employees and business partners are required to adhere to principles of confidentiality protection.

9.  Terms of Service

Ordering and Payment
The services provided by E387 are divided into two categories: those that require user registration and account creation, and those that are accessible to anonymous users without the need for registration or logging in.
9.1 Services Requiring Registration and Account Creation
To access the following services, users must register and create an account through the E387 application using either Apple or Google:
- Adding Vehicles to Garage: Users can add their electric vehicles to a virtual garage for easy management.
- Wallet System: Users can add funds to their wallet for seamless payment processing.
- Transaction History: Users can view a detailed history of all transactions made through the application.
- Charging History: Users can access the history of all charging sessions completed through the E387 network.
- Electric Vehicle Charging: Users can initiate and manage the charging of their electric vehicles at E387 charging stations.
- Adding Favorite Charging Stations: Users can mark and save their preferred charging stations for quick access.
- Contact Us Form: Users can reach out to E387 support directly through the application.
- Real-Time Wallet Notifications: Users receive real-time notifications regarding the status of their wallet, including balance updates.
- Charging Status Notifications: Users are notified about the status of their charging sessions, including any interruptions or completion updates.
- Power Outage Notifications: Users are alerted in case of power outages at charging stations, ensuring they are informed of any disruptions.
9.2 Services Accessible Without Registration
The following services are available to all users, including those who choose not to register or log in:
- Searching for Charging Stations: Users can search for available charging stations within the E387 network.
- Finding Charging Stations on the Map: Users can locate charging stations on a map and view their exact locations.
- Detailed Information on Charging Stations: Users can access comprehensive information about charging stations and individual chargers, including availability and specifications.
- Downloading Directions to Charging Stations: Users can download directions to a selected charging station directly from the application.
- Browsing the Store Section: Users can explore the store section of the application to view available products and services.
- Viewing Nearby Chargers: Users can see a list of chargers available in their vicinity.
- Frequently Asked Questions (FAQ): Users can access the FAQ section for answers to common questions and support information.
Service Users can access and use E387 services through our application by creating an account and selecting the desired charging services. The Fee for the services will be charged based on the usage of the charging stations, and payment will be processed using the registered payment method.
Payment for the services is made online using one of the accepted credit or debit cards: Mastercard®, Maestro®, Visa. All fees are displayed in the local currency and include applicable taxes.

10.  Complaints

10.1 How to File a Complaint
If you experience any issues with our services, including problems with charging, wallet transactions, or any other aspect of the E387 platform, we encourage you to file a complaint so that we can address your concerns promptly. Complaints can be submitted in the following ways:
- Through the E387 Application: You can submit a complaint directly through the "Contact Us" form within the application. Please include all relevant details such as the nature of the issue, date and time of the incident, and any other pertinent information.
- Via Email: Complaints can also be sent to our customer support email at support@e387.com. Make sure to provide detailed information about your issue to help us resolve it efficiently.
10.2 Complaint Handling Process
Once a complaint is received, it will be logged and assigned to a customer service representative for investigation. The process will include:
1. Acknowledgment: You will receive an acknowledgment of your complaint within 24 hours of submission, confirming that it has been received and is being reviewed.
2. Investigation: Our team will investigate the complaint, which may involve reviewing transaction records, examining service logs, and contacting you for additional information if necessary.
3. Resolution: We aim to resolve complaints as quickly as possible. Depending on the complexity of the issue, you can expect a resolution within 5-10 business days. In cases where more time is needed, we will keep you informed of the progress.
4. Outcome: Once the investigation is complete, we will provide you with a detailed explanation of the outcome and any actions that have been taken. If applicable, we will offer a resolution such as a refund, credit to your wallet, or other compensation.

11. Limitation of Liability

The Company, its directors, owners, employees, and any other authorized persons are not responsible for any losses or damages to the Service User caused by using E387 services, applications, or platforms, including but not limited to:
- Direct or indirect loss of property or money.
- Loss of profit, reputation, or data.
- Any other form of loss that provides a legal exemption from liability.

12.  Termination and Suspension of Services

These Terms of Use become effective immediately upon the Service User submitting a request for service and accepting these Terms along with the Privacy Policy. The Service User may terminate this Agreement by sending a request to the Company 7 (seven) days in advance.
The Company may terminate the contract with the Service User for discretionary reasons by sending a notice 3 (three) days in advance. The Company also reserves the right to immediately terminate the contract and suspend the User Account if it determines a violation of the Terms, Privacy Policy, laws, or any other applicable regulations.
The Company may temporarily suspend the User Account during an investigation by the competent authorities. The account will be reactivated once the investigation is complete.

13.  Changes to Terms of Use, Governing Law, and Dispute Resolution

These Terms of Use are effective as of August 2024 and are subject to change. Users will be notified of any changes via email and other applicable forms of communication.
